-TERMS OF SERVICE-

01 General Terms

♦️ Reading the TOS is mandatory, if you ask for a commissioning me it means that you have already read them and you agree.
♦️ Prices are subject to change based on demand.
♦️ I have the right to reject any order for any reason.
♦️ Be courteous at all times and ask if something is not clear to avoid any kind of misunderstanding.
♦️ NOT claim the work as your own or use it for profit.
♦️ Art for merchandising and commercial use are priced completely different (ask me)

02 Payment

♦️ Currency accepted is either USD and can be paid through PayPal.
♦️ Payment must be paid in full before I start working on your commission.
♦️ Don't send any payment before I have agreed to accept the commission.
♦️ NO REFUND after I startet work.

03 Process, Time & Delivery

♦️ Please, fill the order form, be specific, provide me with clear character references: no written descriptions.
♦️ Once I receive the order form I will send you a message confirming your commission and I will send you a Paypal invoice.
♦️ I won´t start the commission until I receive the payment first.
♦️ I will send you a WIP of the sketch, after revisions to pose, accessories and details and you approved of the sketch there will be no more significant changes, only minor changes such as color or environment effects, etc.
♦️ Commission time may vary depending on complexity. (usually 2 weeks - 1 months)
♦️ If there are clients before you, it may take a little longer, I ask that you be patient in these cases. I’ll always try to get it as soon as I can.
♦️ Once finished, you will receive the full-resolution image via E-mail (file PNG). Note that there is no physical product only digital goods.

04 Revisions

♦️ Client is allowed to have 3 revisions max on the sketch phase. Exception: Sketch Color don't have any revisions or correction, you only receive the final result.
♦️ You can ask for revisions additionals (max up to 2 times is included in the price, after WIP approval this applies only to colour and minor changes)
♦️ A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.
♦️ If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.

05 Copyright & Usage

♦️ I retain all copyrights over the commissioned artwork.
♦️ I will not profit further from the commissioned artwork.
♦️ I reserve the right to post the commissioned artwork online and/or post the drawing process on YouTube/Tiktok for promotion purposes. (Unless discussed otherwise)
♦️ You may upload the commissioned artwork on any website and social channels with credit to me, Chii-chan.
♦️ Personal commission: You may NOT make profits from the commissioned piece of any kind (reselling, redistributing, uploading to POD-services, make prints, reposting as promotion, etc.)
♦️ Personal commission are for private person/ groups of persons only
♦️ PROHIBITED to edit out the artwork's watermark or signature.

06 Refunds

♦️ NO REFUND after I started work on your commission, this applies from the sketch.
♦️ If for any reason I am unable to start your commission you will receive a full refund.
♦️ In case YOU might need to cancel on the commission and nothing has been started yet I will give a complete refund.
♦️ If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself within a maximum of 24 hours.

07 Commercial Use

♦️ Clients looking to have work marketed for profit must reach out to me and receive permission in written documented text.
♦️ Clients may not, under any circumstances, use any portion of their commission for AI training, advertising, or profits associated with non-fungible tokens, blockchains, or cryptocurrencies; this is strictly prohibited.
♦️ I will never sell/resell any of my work as non fungible tokens. If artwork I have created, regardless if commissioned or personal, is listed as a non fungible token or is being resold for cryptocurrency, it is stolen. Please report any reposts or resales to me promptly.
♦️ I will not resell a client's commissioned work for profit without their written consent.
♦️ Exceptions apply to: if the commission was abandoned or cancelled while incomplete in which case, depending on the amount of work done, a print may be repurposed or resold. Any elements that are the client's property will not be used in this resale/repurposing, and will be replaced with either my own or another client's character.

01 Condiciones Generales

♦️ La lectura de los TOS es obligatoria, si me pides una puesta en marcha significa que ya los leíste y estás de acuerdo.
♦️ Los precios están sujetos a cambios según la demanda.
♦️ Tengo derecho a rechazar cualquier pedido por cualquier motivo.
♦️ Sea cortés en todo momento y pregunte si algo no le quedó claro para evitar cualquier tipo de malentendido.
♦️NO reclamar la obra como propia ni utilizarla con fines lucrativos.
♦️ El arte para merchandising y uso comercial tienen un precio completamente diferente (pregúntame)

02 Pago

♦️ La moneda aceptada es USD y se puede pagar a través de PayPal.
♦️ El pago debe realizarse en su totalidad antes de comenzar a trabajar en su comisión.
♦️ No envíe ningún pago antes de que haya aceptado la comisión.
♦️ NO HAY REEMBOLSOS después de empezar a trabajar.

03 Proceso, tiempo y entrega

♦️ Por favor, complete el formulario de pedido, sea específico, proporcione referencias de caracteres claras: no descripciones escritas.
♦️ Una vez que reciba el formulario de pedido, le enviaré un mensaje confirmando su comisión y le enviaré una factura de Paypal.
♦️ No comenzaré la comisión hasta que reciba el pago primero.
♦️ Te enviaré un WIP del boceto, después de las revisiones de la pose, los accesorios y los detalles, y si aprobaste el boceto, no habrá cambios más significativos, solo cambios menores como efectos de color o ambientales, etc.
♦️ El tiempo de comisión puede variar dependiendo de la complejidad. (generalmente 2 semanas - 1 mes)
♦️ Si hay clientes antes que usted, puede tardar un poco más, le pido que tenga paciencia en estos casos. Siempre intentaré conseguirlo lo antes posible.
♦️ Una vez terminado, recibirá la imagen de resolución completa por correo electrónico (archivo PNG). Tenga en cuenta que no hay productos físicos, solo productos digitales.

04 Revisiones

♦️ El cliente puede tener 3 revisiones como máximo en la fase de boceto. Excepción: los sketch color no tienen revisiones o correcciones, solo recibes el resultado final.
♦️ Puede solicitar revisiones adicionales (el precio incluye un máximo de 2 veces, después de la aprobación de WIP, esto se aplica solo a cambios de color y menores)
♦️ Se agregará una tarifa si desea que se cambie algo en el dibujo final, a menos que haya habido un malentendido de mi parte.
♦️ Si desea que cambie algo en el dibujo que ha aprobado previamente, le cobraré una tarifa para cambiarlo. El monto del cargo extra depende del cambio que quieras que haga y generalmente se basa en un salario por hora.

05 Derechos de autor y uso

♦️ Retengo todos los derechos de autor sobre la obra de arte encargada.
♦️ No me beneficiaré más de la obra de arte encargada.
♦️ Me reservo el derecho de publicar la obra de arte encargada en línea y/o publicar el proceso de dibujo en YouTube/Tiktok con fines promocionales. (A menos que se indique lo contrario)
♦️ Puedes subir la obra de arte encargada en cualquier sitio web y redes sociales con crédito para mí, Chii-chan.
♦️ Comisión personal: NO puede obtener ganancias de ningún tipo de la pieza encargada (revender, redistribuir, cargar a los servicios POD, hacer impresiones, volver a publicar como promoción, etc.)
♦️ La comisión personal es solo para personas privadas / grupos de personas
♦️ PROHIBIDO editar la marca de agua o la firma de la obra de arte.

06 Reembolsos

♦️ NO HAY REEMBOLSOS después de que comencé a trabajar en tu comisión, esto aplica desde el boceto.
♦️ Si por alguna razón no puedo iniciar su comisión, recibirá un reembolso completo.
♦️ En caso de que USTED necesite cancelar la comisión y aún no se haya iniciado nada, le daré un reembolso completo.
♦️ Si recibe un reembolso, no solicite una devolución de cargo de Paypal. Yo mismo te devolveré el dinero en un plazo máximo de 24 horas.

07 Uso Comercial

♦️ Los clientes que buscan comercializar su trabajo con fines de lucro deben comunicarse conmigo y recibir permiso en un texto documentado por escrito.
♦️ Los clientes no pueden, bajo ninguna circunstancia, utilizar ninguna parte de su comisión para entrenamiento de IA, publicidad o ganancias asociadas con tokens no fungibles, cadenas de bloques o criptomonedas esto se encuentra estrictamente prohibido.
♦️ Nunca venderé/revenderé nada de mi trabajo como tokens no fungibles. Si la obra de arte que he creado, independientemente de si es por encargo o personal, aparece como un token no fungible o se revende por criptomonedas, es robado. Por favor, infórmeme de inmediato sobre cualquier reenvío o reventa.
♦️ No revenderé el trabajo comisionado de un cliente con fines de lucro sin su consentimiento por escrito.
♦️ Se aplican excepciones a: si la comisión fue abandonada o cancelada mientras estaba incompleta, en cuyo caso, dependiendo de la cantidad de trabajo realizado, una impresión puede ser reutilizada o revendida. Cualquier elemento que sea propiedad del cliente no se utilizará en esta reventa/reutilización, y se reemplazará con mi propio personaje o el de otro cliente.
